NSA eavesdropping program ruled unconstitutional

A federal judge on Thursday ruled that the U.S. government's domestic eavesdropping program is unconstitutional and ordered it ended immediately.

...

[U.S. District Judge Anna Diggs Taylor] declared that the program "violates the separation of powers doctrine, the Administrative Procedures Act, the First and Fourth amendments to the United States Constitution, the FISA and Title III."

Her ruling went on to say that "the president of the United States ... has undisputedly violated the Fourth in failing to procure judicial orders."

Naturally, the Bush administration is going to appeal... I'd love to see the Supreme Court show some backbone here and uphold the ruling.

First it's going to the 6th Circuit Court of appeals in Cincinnati, a court that is apparently far more conservative. Damn those liberal, activist, federal judges anyhow! Where do they get off telling Mr. Bush he's not above the law!

I suspect that if/when the Supremes do hear this case, they'll support Ms. Taylor's ruling that the warrantless wiretaps are unconstitutional.
